Seasona — AI Color Analysis & Virtual Try-On

PLEASE READ CAREFULLY. These Terms contain disclaimers, a limitation of liability, an indemnity, and (where permitted) a waiver of class actions. By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, you must not use the App.

1. Acceptance of Terms

By downloading, installing, accessing, or using the Seasona mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). These Terms form a legally binding agreement between you and Viksva, MB, a company registered in Vilnius, Lithuania ("Company," "we," "our," or "us"). If you do not agree, do not use the App.

2. Eligibility and Age Requirements

You must be at least 13 years old to use the App. If the minimum age of digital consent in your country is higher (up to 16 in parts of the EEA), you must meet that age, or use the App only with verifiable consent from a parent or legal guardian.
Because the App processes photographs of you, if you are under the age of majority where you live you may use the App only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.
The App is not intended for, and must not be used to submit photographs of, children.
By using the App, you represent that you meet these requirements and that all information you provide is accurate.

2A. How You Accept These Terms

You accept these Terms and our Privacy Policy when you download, install, or use the App, and (where presented) by tapping to accept or continue at onboarding or purchase. Where required by law, your affirmative in-app action (for example, agreeing to AI processing of your selfie, or completing a purchase) also constitutes your consent to the specific processing described. If you do not agree, do not use the App.

3. Description of Service

Seasona is a style, beauty, and entertainment application that uses artificial intelligence to provide:

Personal color-season analysis and palette suggestions from photos you provide;
Color-match scoring for clothing and other items;
Virtual try-on and makeup try-on images generated by AI;
Wardrobe organization and outfit/style suggestions;
Free features with usage limits, and optional premium subscriptions.

The App's AI features are powered by Google's Gemini AI (see our Privacy Policy).

ENTERTAINMENT ONLY — NOT PROFESSIONAL ADVICE. Seasona is provided strictly for entertainment and informational purposes. Its color-season results, palettes, color-match scores, makeup and outfit recommendations, and virtual try-on images are subjective, approximate, AI-generated opinions, and are NOT professional styling, cosmetic, dermatological, medical, or health advice. Color-analysis systems are inherently subjective and experts disagree; results are not scientific or authoritative. The App does not assess skin health or any medical condition. AI can and will make mistakes, and results may be inaccurate or completely incorrect. Do not rely on the App for any decision that matters. For any skin, health, or professional concern, consult a qualified professional.

4. Virtual Try-On and AI-Generated Images

Virtual try-on and makeup try-on produce AI-generated simulations. They are illustrative only and may be unrealistic, distorted, or inaccurate, and may not reflect how an item, color, or product would actually look on you.
Colors are approximations. The colors, makeup shades, and finishes shown in the App are digital approximations and may differ significantly from the real product. On-screen color depends on your device's screen, brightness, color calibration, and surrounding lighting, as well as your original photo and the AI's rendering. The App does not, and cannot, reproduce exact real-world color, and a shade shown in the App is not a guarantee of the color, name, or appearance of any physical product.
Do not rely on displayed colors or generated images when making purchases; actual products, colors, shades, sizes, and fit will vary. Always check the seller's own color, shade, and product information before buying. We are not responsible for purchases you make or for any dissatisfaction with items you buy.
You will not use generated images to deceive, defame, harass, or misrepresent any person, or in any unlawful manner. You are solely responsible for how you use, save, or share any output.

5. Your Content and License

Your responsibility: You are solely responsible for the photos and content you submit. You represent that you own or have all necessary rights to submit them, that you will only submit photos of yourself or of people who have consented, and that you will not submit photos of children or any unlawful, infringing, or offensive content.
Limited license to operate the App: You grant us a limited, worldwide, non-exclusive, royalty-free license to process the content you submit solely to provide the App's features to you (for example, transmitting your photo to the AI service to generate your result). We do not claim ownership of your content, and we do not use your photos to train our own models. This license ends when your content is deleted, except to the extent processing has already occurred through third parties.
No obligation to store: Your content is generally stored on your device; we are not responsible for backing up or preserving it.

6. Subscriptions and Billing

6.1 Plans

Free Tier: Limited use of core features.
Weekly Subscription: May include a free trial (as shown at purchase), after which recurring weekly billing applies unless cancelled.
Annual Subscription: Recurring annual billing as described at purchase.

Current pricing, trial terms, and features are shown in the App at the time of purchase and control over any general description here.

6.2 Free Trials

Any free trial and its length are disclosed at purchase.
Your payment method is charged automatically when the trial ends unless you cancel before then.
To avoid charges, cancel at least 24 hours before the trial ends.

6.3 Automatic Renewal

IMPORTANT: Subscriptions renew automatically unless cancelled before the current period ends.

Weekly subscriptions renew every 7 days; annual subscriptions renew every 12 months.
Renewal is charged at the then-current price through your App Store or Google Play account.
Renewal, billing, and any advance notice are managed by the respective app store.

6.4 Payment Processing

All payments are processed by your device's app store (Apple App Store or Google Play Store).
Charges apply upon confirmation of purchase or when a free trial ends.

7. Cancellation and Refunds

7.1 How to Cancel

iOS (Apple App Store): Settings → your Apple ID → Subscriptions → Seasona → Cancel Subscription.

Android (Google Play Store): Play Store → profile icon → Payments & subscriptions → Subscriptions → Seasona → Cancel subscription.

You may cancel at any time before the next billing date; cancellation is done through the app store, not within the App.
After cancellation you retain premium access until the end of the current period, then revert to the free tier.

7.2 Refunds

Payments are processed and refunded exclusively by Apple Inc. (App Store) or Google LLC (Google Play), not by us. We do not have the ability to process refunds directly.
Refund requests are subject to the app stores' respective policies. For iOS, visit reportaproblem.apple.com; for Android, use Google Play's refund process.
You can cancel during any free trial to avoid being charged.
This section does not limit any mandatory statutory refund or withdrawal rights you may have under the consumer-protection law of your country of residence. Where such rights apply and cannot be waived, they prevail over anything to the contrary in these Terms.

8. Acceptable Use and Prohibited Conduct

You agree to use the App only for lawful, personal, non-commercial, entertainment purposes. You may not:

Submit photos of other people without their consent, or any photos of children;
Submit unlawful, infringing, offensive, or harmful content;
Use the App or its outputs to identify, surveil, harass, defame, or deceive anyone;
Reverse engineer, decompile, or attempt to extract source code, models, or prompts;
Circumvent usage limits, security, authentication, or App Check measures;
Share, resell, or sublicense your subscription or access;
Use the App for commercial purposes without our written permission;
Interfere with, overload, or attempt unauthorized access to the App or our systems.

Export and sanctions compliance. You represent that you are not located in, and will not use the App from, a country subject to a comprehensive government embargo, and that you are not on any government list of prohibited or restricted parties. You agree to comply with all applicable export-control and sanctions laws.

9. Assumption of Risk

BY USING THE APP YOU ACKNOWLEDGE AND AGREE THAT:

All results are subjective, approximate, AI-generated, and may be completely wrong;
You are solely responsible for any decision or purchase you make based on the App, including buying clothing, cosmetics, or other products;
You will patch-test cosmetics and follow product instructions; we are not responsible for any allergic reaction or harm from products you choose to use;
You voluntarily assume all risk arising from your use of the App and reliance on its outputs, and you release us from claims arising from that use, to the maximum extent permitted by law.

10. Third-Party Services

The App relies on third parties including Google Gemini AI and Firebase (image processing, authentication, analytics), RevenueCat (subscription management), and the Apple App Store and Google Play Store (distribution and payments). These parties have their own terms and privacy policies. We are not responsible for their acts, omissions, availability, or data practices.

11. Intellectual Property

The App and all its content, features, software, models, and branding are owned by Viksva, MB or its licensors and are protected by intellectual-property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use. All rights not expressly granted are reserved.

12. Service Availability and Modifications

We aim for continuous availability but do not guarantee uninterrupted or error-free service.
We may modify, suspend, or discontinue the App or any feature at any time, with or without notice.
Some updates may be required for continued use.

13. Disclaimers and Limitation of Liability

DISCLAIMER OF WARRANTIES. THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RESULTS WILL BE ACCURATE, RELIABLE, OR MEET YOUR EXPECTATIONS.

LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL;
WE WILL NOT BE LIABLE FOR ANY DECISIONS, PURCHASES, OR ACTIONS TAKEN BASED ON THE APP'S OUTPUTS, OR FOR ANY ERRORS OF THIRD-PARTY AI OR OTHER SERVICES;
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (b) EUR 50 (OR THE MINIMUM AMOUNT REQUIRED BY APPLICABLE LAW).

Some jurisdictions do not allow certain exclusions or limitations; in those places, the above applies to the fullest extent permitted, and nothing in these Terms excludes liability that cannot be excluded under mandatory law (such as liability for death or personal injury caused by our negligence, fraud, or gross misconduct).

14. Indemnification

You agree to indemnify, defend, and hold harmless Viksva, MB and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any law or the rights of another (including submitting photos of others without consent); (d) any content you submit; and (e) any decisions or purchases you make based on the App's outputs.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Lithuania, without regard to conflict-of-law principles.
Subject to the paragraph below, disputes will be submitted to the exclusive jurisdiction of the competent courts of Lithuania.
Consumer rights: If you are a consumer resident in the EU/EEA or another jurisdiction with mandatory consumer-protection laws, nothing here deprives you of the protection of, or the right to bring proceedings under, the mandatory laws and courts of your country of residence. EU consumers may also use the European Commission's Online Dispute Resolution platform.

CLASS-ACTION WAIVER (WHERE PERMITTED). To the maximum extent permitted by applicable law, you and we agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. This waiver does not apply where prohibited by law and does not affect mandatory rights of consumers that cannot be waived.

16. Termination

We may suspend or terminate your access to the App at any time, without notice, for any reason including breach of these Terms. Upon termination your license ends; you remain responsible for charges already incurred; and Sections concerning content, disclaimers, limitation of liability, indemnification, assumption of risk, and governing law survive.

17. App Store Terms

17.1 Apple App Store

These Terms are between you and Viksva, MB only, not Apple. Apple is not responsible for the App or its content.
Apple has no obligation to provide support or maintenance for the App.
Payments and refunds are handled by Apple under Apple's policies.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17.2 Google Play Store

These Terms are between you and Viksva, MB only, not Google. Google is not responsible for the App or its content.
Payments and refunds are handled by Google under Google Play's policies.

18. Changes to These Terms

We may modify these Terms at any time. Material changes will be posted here with an updated "Last Updated" date and, where appropriate, in-app notice. Continued use after changes take effect constitutes acceptance.

19. Severability and Entire Agreement

If any provision is held invalid or unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions remain in full effect. These Terms and our Privacy Policy constitute the entire agreement between you and Viksva, MB regarding the App and supersede prior agreements on that subject.
