PLEASE READ CAREFULLY. This Privacy Policy, together with our Terms of Service, contains important disclaimers and limitations of liability. It also explains how we handle photographs of you, including selfies and full-body photos. By downloading, accessing, or using the App, you acknowledge and agree to this Policy. If you do not agree, you must not use the App.

1. Introduction

This Privacy Policy describes how Seasona (the "App"), developed and operated by Viksva, MB, a company registered in Vilnius, Lithuania ("we," "our," or "us"), collects, uses, and protects information when you use our mobile application and related services. We are committed to handling your data transparently and in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR).

ENTERTAINMENT & INFORMATIONAL PURPOSES ONLY — NOT PROFESSIONAL ADVICE. Seasona is a style, beauty, and entertainment tool. Its color-season analysis, palette suggestions, color-match scores, makeup and outfit recommendations, and virtual try-on images are subjective, approximate, AI-generated, and provided for personal entertainment and informational purposes only. They are NOT professional styling, cosmetic, dermatological, medical, or health advice, and are NOT a scientific or authoritative determination of any kind. AI can and will make mistakes, and results may be inaccurate or completely incorrect. The App does not analyze, diagnose, or assess skin health, medical conditions, or any physical condition. Colors and makeup shades shown in the App are digital approximations that depend on your screen and lighting and may differ from the real product, so do not rely on them to match any physical item. Do not rely on the App for any decision that matters, and consult a qualified professional (for example a dermatologist for any skin concern) where appropriate. You use the App entirely at your own risk. See Sections 13–14 and our Terms of Service for the full disclaimers.

4.1 Google Gemini AI (via Firebase / Google Cloud)

Photos and related prompts are processed using Google's Gemini AI to generate color analysis, color-match results, makeup suggestions, and virtual try-on images. Data is transmitted to Google for processing. AI can and will make mistakes; results may be significantly inaccurate or completely incorrect. Google's processing is governed by Google's Privacy Policy. We have no liability for how Google handles, processes, stores, or retains your data.

4.2 Firebase (Authentication, App Check, Cloud Functions, Analytics)

We use Google Firebase for anonymous authentication, abuse prevention (App Check), our backend proxy (Cloud Functions), and usage analytics. Firebase Analytics collects app events, a device/installation identifier, and in-app purchase/subscription events to help us understand usage and improve the App. This data is processed by Google in accordance with Google's Privacy Policy. We use analytics to understand and improve the App, and not to build advertising profiles about you. You can limit analytics and reset or disable the advertising identifier through your device's privacy/tracking settings, and where local law requires consent for analytics, we rely on the choice you make in-app or on your device.

Subject to applicable law, you may have the right to access, correct, delete, restrict, or port your personal data, to object to certain processing, and to withdraw consent. Because most personal data (including your photos) is stored locally on your device, you can exercise many of these rights directly by deleting data in the App or removing the App. For other requests, contact us using the details in Section 11. You also have the right to lodge a complaint with a supervisory authority (in Lithuania, the State Data Protection Inspectorate).

9. Third-Party and Other People's Images

You are responsible for the photos you submit. You must only submit photos that you own or have the right to use, and you must not submit photos of other people without their consent. Do not submit photos of children. We are not responsible for content you choose to submit, and you agree to indemnify us for any claims arising from it (see our Terms of Service).

10. Children's Privacy

The App is not directed to children. You must be at least 13, and where the minimum age of digital consent in your country is higher (up to 16 in parts of the EEA), you must meet that age or have verifiable parental/guardian consent. We do not knowingly collect personal information (including photos) from children under the applicable age, and we do not knowingly process photographs of children. If you believe a child has provided us information, contact us and we will take appropriate steps to delete it.

You agree to indemnify, defend, and hold harmless Viksva, MB and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the App; (b) your violation of this Policy or our Terms; (c) your violation of the rights of another, including submitting photos of other people without consent; (d) any content or images you submit; and (e) any decisions or purchases made based on the App's outputs.

15. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you may have rights to know, delete, correct, and limit the use of your personal information, and to not be discriminated against for exercising them. We do not "sell" your personal information for money, and we do not use it for cross-context behavioral advertising. To the extent any analytics or third-party integration could be considered a "sale" or "share" under California or other U.S. state law, you may opt out through your device's privacy/tracking settings or by contacting us using the details in Section 11. These rights are subject to the limitations in this Policy and applicable law.

16. U.S. Biometric Privacy Laws

To the extent laws such as the Illinois Biometric Information Privacy Act (BIPA) or similar state laws apply, we reiterate: the App analyzes color and appearance characteristics in your photos to generate style suggestions only; it does not create a biometric identifier or faceprint to identify any individual, does not use facial-recognition identification, and does not sell, lease, or profit from biometric information. Any transient processing of facial images is performed with your consent, solely to deliver the results you request.

17. Changes to This Policy

We may update this Policy from time to time. Material changes will be posted here with an updated "Last Updated" date and, where appropriate, in-app notice. Continued use after changes take effect constitutes acceptance.

18. Governing Law

This Policy is governed by the laws of the Republic of Lithuania, without regard to conflict-of-law principles, and subject to any mandatory consumer-protection laws of your country of residence.

NOTHING IN THIS POLICY LIMITS RIGHTS THAT CANNOT BE LIMITED UNDER MANDATORY APPLICABLE LAW, including mandatory consumer rights and, where applicable, liability for death or personal injury caused by negligence, fraud, or gross misconduct. If any provision is held invalid, the remaining provisions remain in full force and effect.

Your photos are processed by Google's Gemini AI to deliver results, are not used to identify you, and are not stored on our servers. Use the App at your own risk. If you do not agree, do not use the App.
