By using this app, you acknowledge and agree to these limitations. We strongly recommend reading these terms carefully before using our services. If you do not agree to any part of these terms, you must not use our app.
1. Acceptance of Terms
By downloading, installing, accessing, or using the AI Garden Planner mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Viksva, MB, a company registered in Vilnius, Lithuania ("Company," "we," "our," or "us").
IMPORTANT: If you do not agree to these Terms, do not download, install, access, or use the App. Your continued use of the App constitutes acceptance of these Terms and any modifications we may make to them.
2. Description of Service
AI Garden Planner is a mobile application that uses Google Gemini artificial intelligence to provide gardening assistance including plant identification, garden planning, planting calendars, pest and disease diagnosis, and gardening advice. The App provides:
- Plant identification through AI-powered image analysis using Google Gemini AI and/or OpenAI (ChatGPT) models
- Plant health diagnosis and pest/disease identification based on visual analysis
- AI-powered garden chat assistant for gardening questions and advice
- Garden layout planning with drag-and-drop grid editor
- Personalized planting calendars based on climate zone and frost dates
- Companion planting suggestions and recommendations
- Harvest tracking with AI-assisted weight estimation
- Photo journal for tracking plant growth
- Task management including watering and fertilizing reminders
- Basic features for free users with monthly usage limits
- Premium subscription tiers with enhanced features and unlimited usage

This app is an EDUCATIONAL AND ENTERTAINMENT TOOL ONLY. AI technology can and does make mistakes, and ALL information provided by this app - including but not limited to plant identifications, gardening advice, planting recommendations, planting schedules, companion planting suggestions, pest/disease diagnoses, treatment recommendations, harvest estimates, and any other output - may contain significant errors, inaccuracies, or be completely incorrect. ALL INFORMATION PROVIDED IS APPROXIMATE AND SHOULD NOT BE RELIED UPON FOR ANY CRITICAL PURPOSE. We do not guarantee the accuracy, precision, or correctness of any information provided by the app. You MUST NOT rely on this app for: (1) identifying whether plants are safe to eat, touch, or handle; (2) diagnosing plant diseases that may affect food safety; (3) determining pesticide or chemical treatments; (4) any purpose requiring certified or expert horticultural advice; (5) commercial farming or agricultural decisions; (6) any situation where incorrect advice could cause harm to persons, animals, property, or the environment. You MUST consult professional horticulturists, agronomists, certified master gardeners, local agricultural extension services, or other qualified professionals for any advice that matters. We take ABSOLUTELY NO RESPONSIBILITY for any errors in identification, diagnosis, or advice.
CRITICAL HEALTH AND SAFETY WARNING: NEVER eat, consume, touch, handle, or apply any plant, substance, treatment, or product based solely on information provided by this app. AI-generated plant identifications may be INCORRECT and could lead to SERIOUS INJURY, ILLNESS, POISONING, ALLERGIC REACTIONS, OR DEATH if you consume or handle misidentified plants. ALWAYS verify plant identification with a qualified professional before consuming or handling any plant. We have ABSOLUTELY NO LIABILITY for any health consequences, injuries, poisoning, allergic reactions, or death resulting from reliance on this app's plant identifications or recommendations.
3. Subscription Plans and Billing
3.1 Available Subscription Tiers
We offer the following subscription plans:
- Free Tier: Limited to 3 plant scans per month, 10 photos per month, and 1 garden
- Weekly Subscription: Includes a 3-day free trial period, after which you will be charged for weekly access to premium features including unlimited scans, photos, and gardens
- Yearly Subscription: Annual access to premium features with immediate billing upon subscription
3.2 Free Trial Terms
- The weekly subscription includes a 3-day free trial that begins immediately upon subscription
- You will have full access to premium features during the trial period
- Your payment method will be charged automatically when the trial period expires unless you cancel before the trial ends
- The yearly subscription does not include a free trial period and billing begins immediately
3.3 Automatic Renewal
IMPORTANT: All subscriptions automatically renew unless cancelled before the current billing period expires.
- Weekly subscriptions automatically renew every 7 days
- Yearly subscriptions automatically renew every 365 days
- You will be charged for the renewal at the same rate as your original subscription
- Renewal charges occur through your App Store or Google Play Store account
- You will not receive advance notice of renewal charges as this is managed by the respective app store
3.4 Payment Processing
- All payments are processed through your device's app store (Apple App Store or Google Play Store)
- Payment will be charged to your app store account upon confirmation of purchase or after the free trial period expires
- Subscription management, including billing, is handled by the respective app store
4. Subscription Management and Cancellation
4.1 How to Cancel Your Subscription
For iOS (Apple App Store):
- Open the Settings app on your iOS device
- Tap your Apple ID at the top of the screen
- Tap "Subscriptions"
- Find "AI Garden Planner" and tap it
- Tap "Cancel Subscription"
For Android (Google Play Store):
- Open the Google Play Store app
- Tap the profile icon in the top right
- Tap "Payments & subscriptions" then "Subscriptions"
- Find "AI Garden Planner" and tap it
- Tap "Cancel subscription"
4.2 Effect of Cancellation
- You may cancel your subscription at any time before the next billing cycle
- Cancellation must be done through your app store account, not through the App itself
- After cancellation, you will retain access to premium features until the end of your current billing period
- Once your current billing period expires, you will lose access to premium features but can continue using basic free features
- Your garden data and history will be preserved
4.3 Refunds
NO REFUND POLICY:
- No Refunds: We do not offer refunds for any purchases made through the App
- All Sales Final: All subscription purchases are final and non-refundable
- Payment Processing: All payments are processed and handled exclusively by Apple Inc. (Apple App Store) or Google LLC (Google Play Store), not by us
- App Store Responsibility: Apple and Google have sole control over payment processing, billing, and any refund decisions. We do not have the ability to process refunds directly
- App Store Refund Requests: If you believe you are entitled to a refund under Apple's or Google's refund policies, you must contact the respective app store directly following their refund request procedures
- Apple Refund Process: For iOS users, visit reportaproblem.apple.com or contact Apple Support directly
- Google Refund Process: For Android users, visit the Google Play Store support or request a refund through your Google Play account
- Our Limited Role: We have no control over or responsibility for app store refund decisions. Any refund requests are subject to Apple's and Google's respective refund policies, not ours
- Free Trial Reminder: You can cancel during the 3-day free trial period (weekly subscription) to avoid being charged
5. User Responsibilities and Prohibited Uses
5.1 Acceptable Use
You agree to use the App only for lawful, educational, and entertainment purposes and in accordance with these Terms. You are responsible for:
- Maintaining the security of your device and account
- Ensuring you have the right to submit any images or content for analysis
- Using the service in compliance with all applicable laws and regulations
- Understanding that ALL information provided by this app is approximate and for educational/entertainment purposes only
- NOT relying on the app for professional horticultural, agricultural, or botanical advice
- NEVER consuming, handling, or applying any plant, substance, or treatment based solely on the app's identification or recommendation without professional verification
- Consulting professional horticulturists, agronomists, or local agricultural extension services for any advice that matters
- Verifying all plant identifications with qualified professionals before consuming or handling plants
- Understanding that AI-generated advice can be significantly inaccurate or completely wrong
- NOT using the app for commercial agriculture, food safety, or any purpose where incorrect advice could cause harm
- Taking full personal responsibility for any actions you take based on the app's outputs
5.2 Prohibited Activities
You may not:
- Use the App for any illegal or unauthorized purpose
- Reverse engineer, decompile, or disassemble the App
- Share your subscription access with others
- Submit content that violates intellectual property rights
- Attempt to circumvent usage limitations or technical measures
- Use the App in a way that could damage or impair our services
- Submit inappropriate, offensive, or harmful content
- Use the App for commercial purposes without our written permission
- Attempt to gain unauthorized access to our systems or other users' accounts
- Rely on the App as a sole source of information for food safety, plant toxicity, or any health-related decisions
6. Privacy and Data Collection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
7. Intellectual Property
The App and all its content, features, and functionality are owned by Viksva, MB and are protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App solely for your personal, non-commercial use.
8. Third-Party Services and AI Limitations
The App integrates with third-party services including but not limited to:
- Google Gemini AI for image analysis, plant identification, health diagnosis, and gardening advice
- OpenAI (ChatGPT) for image analysis, plant identification, health diagnosis, and gardening advice
- RevenueCat for subscription management
- Apple App Store and Google Play Store for payment processing
- Analytics services for app improvement
These third parties have their own terms of service and privacy policies. We are not responsible for the practices or content of these third-party services.
AI LIMITATIONS AND ERRORS: The AI technology used in this app (Google Gemini AI and/or OpenAI (ChatGPT)) can and WILL make mistakes. AI-generated plant identifications, gardening advice, planting recommendations, pest/disease diagnoses, companion planting suggestions, harvest estimates, and all other app outputs may contain significant errors, inaccuracies, or be completely incorrect. AI output is NOT accurate and should NOT be treated as professional, certified, or authoritative advice. This is an EDUCATIONAL AND ENTERTAINMENT TOOL ONLY, not a professional horticultural or agricultural service. ALL INFORMATION IS APPROXIMATE. Accuracy depends on many unpredictable factors including image quality, plant condition, lighting, angle, season, and AI interpretation errors. You MUST consult professional horticulturists, agronomists, or local agricultural extension services for any advice that matters. We have ABSOLUTELY NO LIABILITY for any errors, inaccuracies, or incorrect information produced by AI services. DO NOT rely on this app for food safety, plant toxicity identification, chemical treatment decisions, or any purpose where incorrect information could cause harm to persons, animals, property, or the environment.
9. Assumption of Risk
ASSUMPTION OF RISK: BY USING THIS APP, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:
- Gardening involves inherent risks including but not limited to exposure to allergens, toxic plants, pesticides, chemicals, physical injury, and environmental hazards
- You assume ALL RISK associated with any actions you take based on information provided by this app
- You are solely responsible for verifying the safety and accuracy of any plant identification, gardening advice, treatment recommendation, or other information before acting upon it
- You will NEVER consume, handle, or apply any plant, substance, or treatment based solely on the app's output without independent professional verification
- You understand that AI-generated information may be COMPLETELY WRONG and could lead to serious harm if relied upon without verification
- You voluntarily assume all risks of loss, damage, injury, illness, or death that may result from your use of this app or reliance on its outputs
- You release and discharge us from any and all claims, demands, or causes of action arising from your use of this app
10. Service Availability and Modifications
- We strive to provide continuous service but cannot guarantee uninterrupted availability
- We reserve the right to modify, suspend, or discontinue the App or any features at any time
- We may update the App to improve functionality, security, or compliance
- Critical updates may be required for continued service access
11. Disclaimers and Limitation of Liability

- This is an EDUCATIONAL AND ENTERTAINMENT TOOL ONLY, not a professional gardening, agricultural, or botanical service
- AI technology CAN AND WILL make mistakes - ALL information may contain significant errors, inaccuracies, or be completely incorrect
- ALL INFORMATION IS APPROXIMATE AND UNRELIABLE for any critical, commercial, health, safety, or professional purposes
- You MUST consult professional horticulturists, agronomists, or agricultural extension services for any advice that matters
- We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
- We are not responsible for any consequences resulting from reliance on any information provided by this app
- We do not guarantee that the app will meet your requirements or expectations

- We are not liable for any decisions made based on app outputs
11.2 Limitation of Liability

- WE SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY DAMAGES, LOSSES, OR CLAIMS ARISING FROM USE OF THIS APP, ITS AI FEATURES, OR ANY INFORMATION PROVIDED BY THE APP

- WE ARE NOT LIABLE FOR ANY ENVIRONMENTAL DAMAGE, SOIL CONTAMINATION, WATER CONTAMINATION, OR ECOLOGICAL HARM RESULTING FROM FOLLOWING THE APP'S ADVICE
- WE ARE NOT LIABLE FOR ANY MISIDENTIFICATION OF TOXIC, POISONOUS, ALLERGENIC, OR HARMFUL PLANTS
- WE ARE NOT LIABLE FOR ANY FINANCIAL, COMMERCIAL, AGRICULTURAL, LEGAL, OR PERSONAL LOSSES RESULTING FROM YOUR USE OF THE APP
- WE ARE NOT LIABLE FOR ANY HARM TO PERSONS, ANIMALS, PROPERTY, OR THE ENVIRONMENT RESULTING FROM RELIANCE ON THIS APP
12. Indemnification
INDEMNIFICATION: You agree to indemnify and hold harmless Viksva, MB, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Any content or images you submit through the App
- Any consequences resulting from reliance on plant identifications, gardening advice, planting recommendations, pest/disease diagnoses, or any other information provided by the App
- Any decisions made based on the App's outputs
- Any errors, inaccuracies, or incorrect information provided by AI services (Google Gemini AI and/or OpenAI (ChatGPT))
- Any crop losses, plant damage, garden failures, or property damage resulting from following the App's advice
- Any health issues, allergic reactions, poisoning, illness, injury, or death resulting from consuming, handling, or applying plants, substances, or treatments identified or recommended by the App
- Any environmental damage resulting from following the App's advice
- Any harm to persons, animals, property, or the environment resulting from your use of the App
- Any violations of laws or regulations arising from use of this App
13. Termination
We may terminate or suspend your access to the App immediately, without prior notice, for any reason including violation of these Terms. Upon termination:
- Your right to use the App ceases immediately
- You remain liable for all charges incurred prior to termination
- Subscription billing continues until cancelled through your app store account
- Provisions regarding liability, indemnification, assumption of risk, and governing law survive termination
14. Governing Law and Dispute Resolution
- These Terms are governed by the laws of Lithuania
- Any disputes shall be resolved exclusively in the courts of Lithuania
- You consent to the jurisdiction of Lithuanian courts
- If any provision of these Terms is found unenforceable, the remaining provisions remain in effect
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by:
- Posting updated Terms in the App
- Updating the "Last Updated" date
- Providing in-app notification for significant changes
Continued use of the App after changes constitutes acceptance of the updated Terms.
16. App Store Specific Terms
16.1 Apple App Store Additional Terms
For users who download the App from the Apple App Store, the following additional terms apply:
- These Terms are between you and Viksva, MB only, not with Apple Inc.
- Apple is not responsible for the App or its content
- Apple has no obligation to provide support services for the App
- All payments and refunds are handled exclusively by Apple in accordance with Apple's policies
- Apple is a third-party beneficiary of these Terms and may enforce them against you
- Apple is not responsible for any consequences resulting from plant identifications, gardening advice, or your use of the App
16.2 Google Play Store Additional Terms
For users who download the App from Google Play Store, the following additional terms apply:
- These Terms are between you and Viksva, MB only, not with Google LLC
- Google is not responsible for the App or its content
- Google has no obligation to provide support services for the App
- All payments and refunds are handled exclusively by Google in accordance with Google Play's policies
- Google is not responsible for any consequences resulting from plant identifications, gardening advice, or your use of the App

18. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Viksva, MB regarding the use of the App and supersede all prior agreements and understandings.
FINAL WARNING: By using this app, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. ALL PLANT IDENTIFICATIONS, GARDENING ADVICE, PLANTING RECOMMENDATIONS, PEST/DISEASE DIAGNOSES, AND ANY OTHER INFORMATION PROVIDED BY THIS APP ARE APPROXIMATE AND FOR EDUCATIONAL/ENTERTAINMENT PURPOSES ONLY. AI CAN AND WILL MAKE MISTAKES. NEVER consume, handle, or apply any plant, substance, or treatment based solely on the app's output without independent professional verification. DO NOT rely on this app for food safety, plant toxicity, commercial agriculture, or any critical purpose. We take ABSOLUTELY NO RESPONSIBILITY for any crop losses, plant damage, health issues, property damage, environmental damage, personal injury, illness, or death resulting from use of this app. You assume ALL RISK associated with your use of this app. Consult professional horticulturists, agronomists, or agricultural extension services for any advice that matters. These terms are designed to protect our interests and limit our liability to the maximum extent permitted by law.
