CRITICAL WARNING: These Terms of Service contain extensive limitations and disclaimers designed to protect our interests and limit our liability. By using this app, you acknowledge and agree to these limitations. We strongly recommend reading these terms carefully before using our services. If you do not agree to any part of these terms, you must not use our app.
1. Acceptance of Terms
By downloading, installing, accessing, or using the Scale For Grams: Measure Tool mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Viksva, MB, a company registered in Vilnius, Lithuania ("Company," "we," "our," or "us").
1.1 Age Requirement
You must be at least 16 years of age to use this App. By using the App, you represent and warrant that you are at least 16 years old. If you are under 16 years of age, you are not permitted to use the App. We do not knowingly collect or solicit personal information from anyone under the age of 16.
IMPORTANT: If you do not agree to these Terms, do not download, install, access, or use the App. Your continued use of the App constitutes acceptance of these Terms and any modifications we may make to them.
2. Description of Service
Scale For Grams: Measure Tool is a mobile application that uses Google Gemini artificial intelligence to analyze images of objects and provide approximate weight estimations. The App provides:
- Object weight estimation through AI-powered image analysis using Google Gemini AI models
- Visual weight measurement based on object appearance, size, and characteristics
- Measurement history and tracking
- Basic features for free users with daily usage limits
- Premium subscription tiers with enhanced features and unlimited usage
- Multiple measurement units (grams, ounces, pounds, etc.)
MEASUREMENT ACCURACY AND INFORMATIONAL DISCLAIMER: This app is provided STRICTLY for educational, entertainment, and informational purposes only and is NOT a substitute for a professional or calibrated weighing scale. This app is an EDUCATIONAL AND ENTERTAINMENT TOOL ONLY. AI technology can and does make mistakes, and weight estimations may contain significant errors, inaccuracies, or be completely incorrect. ALL WEIGHT ESTIMATIONS ARE APPROXIMATE AND SHOULD NOT BE RELIED UPON FOR ANY CRITICAL, COMMERCIAL, TRADE, LEGAL, MEDICAL, OR PROFESSIONAL PURPOSE. We do not guarantee the accuracy, precision, or correctness of any weight estimation provided by the app. Measurement accuracy depends on many factors including image quality, camera calibration, object type, lighting conditions, and AI interpretation. You MUST NOT use this app for: (1) commercial trade or sales; (2) legal or regulatory compliance; (3) medical or pharmaceutical dosing; (4) food safety or nutrition calculations; (5) shipping or postal services; (6) scientific or laboratory measurements; (7) any purpose requiring certified or calibrated measurements. You MUST use a professional, calibrated weighing scale for any important measurements. Results may vary significantly and are completely approximate. We take ABSOLUTELY NO RESPONSIBILITY for any errors in weight estimation.
3. Subscription Plans and Billing
3.1 Available Subscription Tiers
We offer the following subscription plans:
- Weekly Subscription: Includes a 3-day free trial period, after which you will be charged for weekly access to premium features
- Yearly Subscription: Annual access to premium features with immediate billing upon subscription
- Lifetime Subscription: One-time purchase granting access to premium features for the operational lifetime of the Application (see Section 3.5 for definition)
3.2 Free Trial Terms
- The weekly subscription includes a 3-day free trial that begins immediately upon subscription
- You will have full access to premium features during the trial period
- Your payment method will be charged automatically when the trial period expires unless you cancel before the trial ends
- The yearly subscription does not include a free trial period and billing begins immediately
3.3 Automatic Renewal
IMPORTANT: All subscriptions automatically renew unless cancelled before the current billing period expires.
- Weekly subscriptions automatically renew every 7 days
- Yearly subscriptions automatically renew every 365 days
- You will be charged for the renewal at the same rate as your original subscription
- Renewal charges occur through your App Store or Google Play Store account
- You will not receive advance notice of renewal charges as this is managed by the respective app store
3.4 Payment Processing
- All payments are processed through your device's app store (Apple App Store or Google Play Store)
- Payment will be charged to your app store account upon confirmation of purchase or after the free trial period expires
- Subscription management, including billing, is handled by the respective app store
3.5 Lifetime Subscription Definition
IMPORTANT - DEFINITION OF "LIFETIME":
The term "Lifetime Subscription" or "Lifetime Access" refers exclusively to the operational lifetime of the Application, NOT the lifetime of the subscriber or purchaser. By purchasing a Lifetime Subscription, you acknowledge and agree to the following:
- Definition: "Lifetime" means the period during which the Application is actively developed, maintained, supported, and made available by Viksva, MB
- No Perpetual Guarantee: A Lifetime Subscription does not represent a guarantee of perpetual, indefinite, or unlimited access to the Application or its features
- Service Discontinuation: The Company reserves the right to discontinue, modify, replace, or cease operations of the Application at any time, for any reason, at its sole discretion
- No Refunds Upon Discontinuation: In the event the Application is discontinued, substantially modified, or replaced, no refunds (partial or full) shall be owed to Lifetime Subscription holders
- Feature Changes: The Company may add, remove, or modify features of the Application at any time. Lifetime Subscription access applies to the Application as it exists at any given time
- Platform Dependency: Lifetime access is contingent upon the continued availability of the Application on the Apple App Store and/or Google Play Store. If the Application is removed from app stores, access may be affected
- Device Compatibility: Continued access depends on device and operating system compatibility. We do not guarantee compatibility with future devices or operating system versions
- Transfer Restrictions: Lifetime Subscriptions are non-transferable and are tied to your app store account
By purchasing a Lifetime Subscription, you expressly acknowledge that you understand and accept these terms regarding the meaning and limitations of "lifetime" access.
4. Subscription Management and Cancellation
4.1 How to Cancel Your Subscription
For iOS (Apple App Store):
- Open the Settings app on your iOS device
- Tap your Apple ID at the top of the screen
- Tap "Subscriptions"
- Find "Scale For Grams" and tap it
- Tap "Cancel Subscription"
For Android (Google Play Store):
- Open the Google Play Store app
- Tap the profile icon in the top right
- Tap "Payments & subscriptions" → "Subscriptions"
- Find "Scale For Grams" and tap it
- Tap "Cancel subscription"
4.2 Effect of Cancellation
- You may cancel your subscription at any time before the next billing cycle
- Cancellation must be done through your app store account, not through the App itself
- After cancellation, you will retain access to premium features until the end of your current billing period
- Once your current billing period expires, you will lose access to premium features but can continue using basic free features
- Your account data and measurement history will be preserved
4.3 Refunds
NO REFUND POLICY:
- No Refunds: We do not offer refunds for any purchases made through the App
- All Sales Final: All subscription purchases are final and non-refundable
- Payment Processing: All payments are processed and handled exclusively by Apple Inc. (Apple App Store) or Google LLC (Google Play Store), not by us
- App Store Responsibility: Apple and Google have sole control over payment processing, billing, and any refund decisions. We do not have the ability to process refunds directly
- App Store Refund Requests: If you believe you are entitled to a refund under Apple's or Google's refund policies, you must contact the respective app store directly following their refund request procedures
- Apple Refund Process: For iOS users, visit reportaproblem.apple.com or contact Apple Support directly
- Google Refund Process: For Android users, visit the Google Play Store support or request a refund through your Google Play account
- Our Limited Role: We have no control over or responsibility for app store refund decisions. Any refund requests are subject to Apple's and Google's respective refund policies, not ours
- Free Trial Reminder: You can cancel during the 3-day free trial period (weekly subscription) to avoid being charged
4.4 EU Consumer Right of Withdrawal
NOTICE TO EU CONSUMERS:
Under EU consumer protection law, you may have a 14-day right of withdrawal for digital purchases. However, by purchasing a subscription and immediately accessing premium features, you expressly consent to the immediate performance of the service and acknowledge that you lose your right of withdrawal once the digital content has been accessed or the service has begun.
By completing your purchase and using premium features, you:
- Expressly request that the service begins immediately upon purchase
- Acknowledge that you lose your right to withdraw once you access the digital content or premium features
- Understand that this consent is required under Article 16(m) of the EU Consumer Rights Directive (2011/83/EU)
If you do not wish to waive your withdrawal right, do not use the premium features during the 14-day withdrawal period.
5. User Responsibilities and Prohibited Uses
5.1 Acceptable Use
You agree to use the App only for lawful, educational, and entertainment purposes and in accordance with these Terms. You are responsible for:
- Maintaining the security of your device and account
- Ensuring you have the right to submit any images or content for analysis
- Using the service in compliance with all applicable laws and regulations
- Understanding that all weight estimations are approximate and for educational/entertainment purposes only
- NOT relying on the app for commercial, trade, legal, medical, or professional weight measurements
- Using a professional calibrated scale for any important or critical measurements
- Verifying all weight measurements with proper calibrated weighing equipment when accuracy matters
- Understanding that AI-based weight estimations can be significantly inaccurate
- Not using the app for medical dosing, commercial trade, food safety, shipping, or any regulated purposes
5.2 Prohibited Activities
You may not:
- Use the App for any illegal or unauthorized purpose
- Reverse engineer, decompile, or disassemble the App
- Share your subscription access with others
- Submit content that violates intellectual property rights
- Attempt to circumvent usage limitations or technical measures
- Use the App in a way that could damage or impair our services
- Submit inappropriate, offensive, or harmful content
- Use the App for commercial purposes without our written permission
- Attempt to gain unauthorized access to our systems or other users' accounts
6. Privacy and Data Collection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
7. Intellectual Property
The App and all its content, features, and functionality are owned by Viksva, MB and are protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App solely for your personal, non-commercial use.
8. Third-Party Services and AI Limitations
The App integrates with third-party services including but not limited to:
- Google Gemini AI for image analysis and weight estimation processing
- RevenueCat for subscription management
- Apple App Store and Google Play Store for payment processing
- Analytics services for app improvement
These third parties have their own terms of service and privacy policies. We are not responsible for the practices or content of these third-party services.
AI LIMITATIONS AND ERRORS: The AI technology used in this app (Google Gemini AI) can and WILL make mistakes. AI-generated weight estimations may contain significant errors, inaccuracies, or be completely incorrect. AI weight estimation is NOT accurate and should NOT be treated as a professional, calibrated, or authoritative measurement. This is an EDUCATIONAL AND ENTERTAINMENT TOOL ONLY, not a professional weighing scale. ALL MEASUREMENTS ARE APPROXIMATE. Accuracy depends on many unpredictable factors including image quality, camera calibration, object type, size, density, lighting, angle, and AI interpretation errors. You MUST use a professional calibrated scale for any measurements that matter. We have ABSOLUTELY NO LIABILITY for any errors, inaccuracies, or incorrect weight estimations produced by AI services. DO NOT use this app for commercial, medical, legal, trade, shipping, or any regulated purposes.
9. Service Availability and Modifications
- We strive to provide continuous service but cannot guarantee uninterrupted availability
- We reserve the right to modify, suspend, or discontinue the App or any features at any time
- We may update the App to improve functionality, security, or compliance
- Critical updates may be required for continued service access
10. Disclaimers and Limitation of Liability
10.1 Service Disclaimers
IMPORTANT: The App is provided "as is" and "as available" without warranties of any kind.
- We do not guarantee the accuracy, precision, or correctness of any weight estimations or measurements provided by the app
- The App is STRICTLY for educational, entertainment, and informational purposes only and is NOT a substitute for professional calibrated weighing equipment
- This is an EDUCATIONAL AND ENTERTAINMENT TOOL ONLY, not a professional weighing scale or measurement device
- AI technology CAN AND WILL make mistakes - weight estimations may contain significant errors, inaccuracies, or be completely incorrect
- ALL WEIGHT ESTIMATIONS ARE APPROXIMATE AND UNRELIABLE for any critical, commercial, medical, legal, or professional purposes
- You MUST use professional calibrated scales for any measurements that matter
- We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
- We are not responsible for any consequences resulting from reliance on weight estimations provided by this app
- We do not guarantee that the app will meet your requirements or expectations
- We are not responsible for any errors, inaccuracies, or incorrect weight estimations provided by AI services (Google Gemini AI)
- Estimation accuracy varies significantly based on object type, image quality, camera calibration, lighting, and other unpredictable factors
- We are not liable for any decisions made based on app measurements
10.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
- OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM
- WE ARE NOT RESPONSIBLE FOR DAMAGES ARISING FROM THIRD-PARTY SERVICES OR APP STORE POLICIES
- YOU ACKNOWLEDGE THAT YOUR USE OF THE APP IS AT YOUR SOLE RISK
- WE ARE NOT LIABLE FOR ANY CONSEQUENCES RESULTING FROM RELIANCE ON WEIGHT ESTIMATIONS PROVIDED BY THIS APP
- WE ARE NOT RESPONSIBLE FOR ANY DECISIONS MADE BASED ON THE APP'S WEIGHT ESTIMATIONS OR MEASUREMENTS
- WE ARE NOT LIABLE FOR ANY ERRORS, INACCURACIES, OR INCORRECT WEIGHT ESTIMATIONS PROVIDED BY AI SERVICES (GOOGLE GEMINI AI)
- WE ARE NOT RESPONSIBLE FOR ANY DATA LOSS, SERVICE INTERRUPTIONS, OR TECHNICAL ISSUES
- WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM YOUR RELIANCE ON THE APP'S OUTPUT
- WE ARE NOT RESPONSIBLE FOR ANY FINANCIAL, COMMERCIAL, LEGAL, OR PERSONAL LOSSES RESULTING FROM YOUR USE OF THE APP
- WE ARE NOT LIABLE FOR ANY LOSSES ARISING FROM INACCURATE WEIGHT MEASUREMENTS INCLUDING BUT NOT LIMITED TO: COMMERCIAL TRANSACTIONS, SHIPPING ERRORS, MEDICAL DOSING ERRORS, FOOD SAFETY ISSUES, LEGAL COMPLIANCE FAILURES, OR TRADE DISPUTES
- WE ARE NOT RESPONSIBLE FOR ANY HARM, INJURY, OR DAMAGES ARISING FROM USE OF INCORRECT WEIGHT MEASUREMENTS
- WE ARE NOT LIABLE FOR ANY REGULATORY VIOLATIONS OR LEGAL ISSUES ARISING FROM USE OF THIS APP
11. Indemnification
INDEMNIFICATION: You agree to indemnify and hold harmless Viksva, MB, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Any content or images you submit through the App
- Any consequences resulting from reliance on weight estimations provided by the App
- Any decisions made based on the App's weight estimations or measurements
- Any errors, inaccuracies, or incorrect weight estimations provided by AI services (Google Gemini AI)
- Any commercial, trade, legal, medical, or regulatory issues arising from use of weight estimations
- Any financial losses resulting from inaccurate measurements
- Any harm, injury, or damages arising from use of incorrect weight measurements
- Any violations of laws or regulations arising from use of this App
12. Termination
We may terminate or suspend your access to the App immediately, without prior notice, for any reason including violation of these Terms. Upon termination:
- Your right to use the App ceases immediately
- You remain liable for all charges incurred prior to termination
- Subscription billing continues until cancelled through your app store account
- Provisions regarding liability, indemnification, and governing law survive termination
13. Governing Law and Dispute Resolution
- These Terms are governed by the laws of Lithuania
- Any disputes shall be resolved exclusively in the courts of Lithuania
- You consent to the jurisdiction of Lithuanian courts
- If any provision of these Terms is found unenforceable, the remaining provisions remain in effect
13.1 EU Online Dispute Resolution
For consumers residing in the European Union: The European Commission provides an Online Dispute Resolution (ODR) platform for the resolution of disputes. You can access the ODR platform at: https://ec.europa.eu/consumers/odr

14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by:
- Posting updated Terms in the App
- Updating the "Last Updated" date
- Providing in-app notification for significant changes
Continued use of the App after changes constitutes acceptance of the updated Terms.
15. App Store Specific Terms
15.1 Apple App Store Additional Terms
For users who download the App from the Apple App Store, the following additional terms apply:
- These Terms are between you and Viksva, MB only, not with Apple Inc.
- Apple is not responsible for the App or its content
- Apple has no obligation to provide support services for the App
- All payments and refunds are handled exclusively by Apple in accordance with Apple's policies
- Apple is a third-party beneficiary of these Terms and may enforce them against you
- Apple is not responsible for any consequences resulting from weight estimations or your use of the App
15.2 Google Play Store Additional Terms
For users who download the App from Google Play Store, the following additional terms apply:
- These Terms are between you and Viksva, MB only, not with Google LLC
- Google is not responsible for the App or its content
- Google has no obligation to provide support services for the App
- All payments and refunds are handled exclusively by Google in accordance with Google Play's policies
- Google is not responsible for any consequences resulting from weight estimations or your use of the App

17. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
18. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
- Acts of God, natural disasters, earthquakes, floods, fires, or severe weather events
- Epidemics, pandemics, or public health emergencies
- War, terrorism, civil unrest, or government actions
- Power outages, internet or telecommunications failures
- Third-party service provider failures (including Google Gemini AI, app stores, cloud services, or payment processors)
- Cyberattacks, hacking, or security breaches beyond our reasonable control
- Changes in laws, regulations, or app store policies
- Labor disputes or supply chain disruptions
During any such event, our obligations under these Terms shall be suspended for the duration of the event, and we shall not be liable for any resulting delays, interruptions, or inability to provide the Service.
19. Waiver
No failure or delay by Viksva, MB in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy. No single or partial exercise of any right, power, or remedy shall preclude any other or further exercise of that right, power, or remedy, or the exercise of any other right, power, or remedy. Our rights under these Terms are cumulative and not exclusive of any other rights provided by law.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Viksva, MB regarding the use of the App and supersede all prior agreements and understandings.
FINAL WARNING: By using this app, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. ALL WEIGHT ESTIMATIONS ARE APPROXIMATE AND FOR EDUCATIONAL/ENTERTAINMENT PURPOSES ONLY. DO NOT rely on this app for commercial, medical, legal, trade, or any critical measurements. Use a professional calibrated scale for any measurements that matter. These terms are designed to protect our interests and limit our liability to the maximum extent permitted by law. We take ABSOLUTELY NO RESPONSIBILITY for any errors in weight estimation. If you do not agree to any part of these terms, you must not use our app. Your continued use of the app constitutes acceptance of these terms and any modifications we may make to them.
