IMPORTANT: If you do not agree to these Terms, do not download, install, access, or use the App. Your continued use of the App constitutes acceptance of these Terms and any modifications we may make to them.
2. Description of Service
Chart AI is a mobile application that uses Google Gemini artificial intelligence to analyze images of trading charts and provide pattern recognition commentary. The App provides:
- Chart pattern analysis through AI-powered image recognition using Google Gemini AI models
- Technical analysis commentary based on visual chart patterns
- Support levels and resistance identification (APPROXIMATE ONLY)
- Trend analysis commentary
- Analysis history and management
- Basic features for free users with daily usage limits
- Premium subscription tiers with enhanced features and unlimited usage

4. Subscription Plans and Billing
4.1 Available Subscription Tiers
We offer the following subscription plans:
- Weekly Subscription: Includes a 3-day free trial period, after which you will be charged for weekly access to premium features
- Yearly Subscription: Annual access to premium features with immediate billing upon subscription
4.2 Free Trial Terms
- The weekly subscription includes a 3-day free trial that begins immediately upon subscription
- You will have full access to premium features during the trial period
- Your payment method will be charged automatically when the trial period expires unless you cancel before the trial ends
- The yearly subscription does not include a free trial period and billing begins immediately
4.3 Automatic Renewal
IMPORTANT: All subscriptions automatically renew unless cancelled before the current billing period expires.
- Weekly subscriptions automatically renew every 7 days
- Yearly subscriptions automatically renew every 365 days
- You will be charged for the renewal at the same rate as your original subscription
- Renewal charges occur through your App Store or Google Play Store account
- You will not receive advance notice of renewal charges as this is managed by the respective app store
4.4 Payment Processing
- All payments are processed through your device's app store (Apple App Store or Google Play Store)
- Payment will be charged to your app store account upon confirmation of purchase or after the free trial period expires
- Subscription management, including billing, is handled by the respective app store
5. Subscription Management and Cancellation
5.1 How to Cancel Your Subscription
For iOS (Apple App Store):
- Open the Settings app on your iOS device
- Tap your Apple ID at the top of the screen
- Tap "Subscriptions"
- Find "Chart AI" and tap it
- Tap "Cancel Subscription"
For Android (Google Play Store):
- Open the Google Play Store app
- Tap the profile icon in the top right
- Tap "Payments & subscriptions" then "Subscriptions"
- Find "Chart AI" and tap it
- Tap "Cancel subscription"
5.2 Effect of Cancellation
- You may cancel your subscription at any time before the next billing cycle
- Cancellation must be done through your app store account, not through the App itself
- After cancellation, you will retain access to premium features until the end of your current billing period
- Once your current billing period expires, you will lose access to premium features but can continue using basic free features
- Your account data and analysis history will be preserved
5.3 Refunds
NO REFUND POLICY:
- No Refunds: We do not offer refunds for any purchases made through the App
- All Sales Final: All subscription purchases are final and non-refundable
- No Refunds for Trading Losses: We do NOT provide refunds based on trading losses, investment performance, or dissatisfaction with analysis accuracy
- Payment Processing: All payments are processed and handled exclusively by Apple Inc. (Apple App Store) or Google LLC (Google Play Store), not by us
- App Store Responsibility: Apple and Google have sole control over payment processing, billing, and any refund decisions. We do not have the ability to process refunds directly
- App Store Refund Requests: If you believe you are entitled to a refund under Apple's or Google's refund policies, you must contact the respective app store directly following their refund request procedures
- Apple Refund Process: For iOS users, visit reportaproblem.apple.com or contact Apple Support directly
- Google Refund Process: For Android users, visit the Google Play Store support or request a refund through your Google Play account
- Our Limited Role: We have no control over or responsibility for app store refund decisions. Any refund requests are subject to Apple's and Google's respective refund policies, not ours
- Free Trial Reminder: You can cancel during the 3-day free trial period (weekly subscription) to avoid being charged
6. User Responsibilities and Prohibited Uses
6.1 Acceptable Use
You agree to use the App only for lawful, educational, and entertainment purposes and in accordance with these Terms. You are responsible for:
- Maintaining the security of your device and account
- Ensuring you have the right to submit any images or content for analysis
- Using the service in compliance with all applicable laws and regulations
- Understanding that all analysis is approximate and for educational/entertainment purposes only
- NOT relying on the app for trading, investment, or financial decisions
- Consulting qualified, licensed financial professionals before making any trading or investment decisions
- Understanding that AI-based analysis can be significantly inaccurate
- Accepting full responsibility for all your trading and investment decisions
- Understanding the substantial risks involved in trading and investing
6.2 Prohibited Activities
You may not:
- Use the App for any illegal or unauthorized purpose
- Reverse engineer, decompile, or disassemble the App
- Share your subscription access with others
- Submit content that violates intellectual property rights
- Attempt to circumvent usage limitations or technical measures
- Use the App in a way that could damage or impair our services
- Submit inappropriate, offensive, or harmful content
- Use the App for commercial purposes without our written permission
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the App to provide financial advice to others
- Represent the App's analysis as professional financial advice
- Use the App in connection with market manipulation or securities fraud
7. Privacy and Data Collection

You are granted a limited, non-exclusive, non-transferable license to use the App solely for your personal, non-commercial use.

The App integrates with third-party services including but not limited to:
- Google Gemini AI for image analysis and chart pattern recognition
- RevenueCat for subscription management
- Apple App Store and Google Play Store for payment processing
- Analytics services for app improvement
These third parties have their own terms of service and privacy policies. We are not responsible for the practices or content of these third-party services.
AI LIMITATIONS AND ERRORS - CRITICAL WARNING:
The AI technology used in this app (Google Gemini AI) can and WILL make mistakes. AI-generated analysis may contain significant errors, inaccuracies, or be completely incorrect.
LIMITATIONS OF TECHNICAL ANALYSIS:
- Chart patterns do NOT guarantee future price movements
- Historical patterns may not repeat
- Support and resistance levels are approximate and may fail
- Trend analysis can be wrong
- Market conditions can change without warning
- Unexpected events can invalidate any analysis
- AI may misidentify patterns or miss important signals
- Analysis does not account for fundamental factors
AI identification is NOT accurate and should NOT be treated as professional, certified, or authoritative analysis. - Any consequences resulting from reliance on analysis provided by the App
- Any trading or investment decisions made based on the App's analysis
- Any errors, inaccuracies, or incorrect analysis provided by AI services (Google Gemini AI)
- Any trading losses, investment losses, or financial losses of any kind
- Any harm or damages arising from use of incorrect analysis or failed chart patterns
- Any violations of securities laws, trading regulations, or other laws arising from your trading activities
- Any claims that you provided financial advice to others based on the App's analysis
- Any regulatory investigations or enforcement actions related to your trading activities
13. Termination
We may terminate or suspend your access to the App immediately, without prior notice, for any reason including violation of these Terms. Upon termination:
- Your right to use the App ceases immediately
- You remain liable for all charges incurred prior to termination
- Subscription billing continues until cancelled through your app store account
- Provisions regarding liability, indemnification, and governing law survive termination
14. Governing Law and Dispute Resolution
- These Terms are governed by the laws of Lithuania
- Any disputes shall be resolved exclusively in the courts of Lithuania
- You consent to the jurisdiction of Lithuanian courts
- If any provision of these Terms is found unenforceable, the remaining provisions remain in effect
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by:
- Posting updated Terms in the App
- Updating the "Last Updated" date
- Providing in-app notification for significant changes
Continued use of the App after changes constitutes acceptance of the updated Terms.

- All payments and refunds are handled exclusively by Apple in accordance with Apple's policies
- Apple is a third-party beneficiary of these Terms and may enforce them against you
- Apple is not responsible for any consequences resulting from analysis, trading decisions, or your use of the App
17.2 Google Play Store Additional Terms
For users who download the App from Google Play Store, the following additional terms apply:
- These Terms are between you and Viksva, MB only, not with Google LLC
- Google is not responsible for the App or its content
- Google has no obligation to provide support services for the App
- All payments and refunds are handled exclusively by Google in accordance with Google Play's policies
- Google is not responsible for any consequences resulting from analysis, trading decisions, or your use of the App

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
20. Entire Agreement
