By using this app, you acknowledge and agree to these limitations. We strongly recommend reading these terms carefully before using our services. 1. Acceptance of Terms
By downloading, installing, accessing, or using the Pest Identifier Bug Scanner / Bug Scanner - Insect ID mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Viksva, MB, a company registered in Vilnius, Lithuania ("Company," "we," "our," or "us").
IMPORTANT: If you do not agree to these Terms, do not download, install, access, or use the App. Your continued use of the App constitutes acceptance of these Terms and any modifications we may make to them.
2. Description of Service
Pest Identifier Bug Scanner / Bug Scanner - Insect ID is a mobile application that uses artificial intelligence to analyze images of insects, bugs, spiders, and other arthropods and provide identification suggestions. The App provides:
- Insect and bug identification through AI-powered image analysis
- Information about identified species including general characteristics
- Identification history and tracking
- Basic features for free users with daily usage limits
- Premium subscription tiers with enhanced features and unlimited usage
- Educational content about insects and arthropods
IDENTIFICATION ACCURACY AND INFORMATIONAL DISCLAIMER: This app is provided STRICTLY for educational, entertainment, and informational purposes only and is NOT a substitute for professional entomological identification, pest control services, or medical advice. This app is an EDUCATIONAL AND ENTERTAINMENT TOOL ONLY. AI technology can and does make mistakes, and species identifications may contain significant errors, inaccuracies, or be completely incorrect. ALL IDENTIFICATIONS ARE APPROXIMATE SUGGESTIONS AND SHOULD NOT BE RELIED UPON FOR ANY CRITICAL, MEDICAL, PEST CONTROL, SAFETY, OR PROFESSIONAL PURPOSE. We do not guarantee the accuracy, precision, or correctness of any identification provided by the app. Identification accuracy depends on many factors including image quality, camera resolution, lighting conditions, insect positioning, and AI interpretation. You MUST NOT use this app for: (1) determining if an insect is venomous, poisonous, or dangerous; (2) medical decisions regarding insect bites, stings, or allergic reactions; (3) professional pest control or extermination decisions; (4) scientific research or academic classification; (5) regulatory or legal compliance; (6) agricultural or commercial pest management; (7) any purpose requiring certified or professional identification. You MUST consult professional entomologists, pest control experts, or medical professionals for any important decisions. Results may vary significantly and are completely approximate. We take ABSOLUTELY NO RESPONSIBILITY for any errors in identification.
3. Subscription Plans and Billing
3.1 Available Subscription Tiers
We offer the following subscription plans:
- Weekly Subscription: Includes a 3-day free trial period, after which you will be charged for weekly access to premium features
- Yearly Subscription: Annual access to premium features with immediate billing upon subscription
3.2 Free Trial Terms
- The weekly subscription includes a 3-day free trial that begins immediately upon subscription
- You will have full access to premium features during the trial period
- Your payment method will be charged automatically when the trial period expires unless you cancel before the trial ends
- The yearly subscription does not include a free trial period and billing begins immediately
3.3 Automatic Renewal
IMPORTANT: All subscriptions automatically renew unless cancelled before the current billing period expires.
- Weekly subscriptions automatically renew every 7 days
- Yearly subscriptions automatically renew every 365 days
- You will be charged for the renewal at the same rate as your original subscription
- Renewal charges occur through your App Store or Google Play Store account
- You will not receive advance notice of renewal charges as this is managed by the respective app store
3.4 Payment Processing
- All payments are processed through your device's app store (Apple App Store or Google Play Store)
- Payment will be charged to your app store account upon confirmation of purchase or after the free trial period expires
- Subscription management, including billing, is handled by the respective app store
4. Subscription Management and Cancellation
4.1 How to Cancel Your Subscription
For iOS (Apple App Store):
- Open the Settings app on your iOS device
- Tap your Apple ID at the top of the screen
- Tap "Subscriptions"
- Find "Bug Scanner - Insect ID" and tap it
- Tap "Cancel Subscription"
For Android (Google Play Store):
- Open the Google Play Store app
- Tap the profile icon in the top right
- Tap "Payments & subscriptions" → "Subscriptions"
- Find "Pest Identifier Bug Scanner" and tap it
- Tap "Cancel subscription"
4.2 Effect of Cancellation
- You may cancel your subscription at any time before the next billing cycle
- Cancellation must be done through your app store account, not through the App itself
- After cancellation, you will retain access to premium features until the end of your current billing period
- Once your current billing period expires, you will lose access to premium features but can continue using basic free features
- Your account data and identification history will be preserved
4.3 Refunds
NO REFUND POLICY:
- No Refunds: We do not offer refunds for any purchases made through the App
- All Sales Final: All subscription purchases are final and non-refundable
- Payment Processing: All payments are processed and handled exclusively by Apple Inc. (Apple App Store) or Google LLC (Google Play Store), not by us
- App Store Responsibility: Apple and Google have sole control over payment processing, billing, and any refund decisions. We do not have the ability to process refunds directly
- App Store Refund Requests: If you believe you are entitled to a refund under Apple's or Google's refund policies, you must contact the respective app store directly following their refund request procedures
- Apple Refund Process: For iOS users, visit reportaproblem.apple.com or contact Apple Support directly
- Google Refund Process: For Android users, visit the Google Play Store support or request a refund through your Google Play account
- Our Limited Role: We have no control over or responsibility for app store refund decisions. Any refund requests are subject to Apple's and Google's respective refund policies, not ours
- Free Trial Reminder: You can cancel during the 3-day free trial period (weekly subscription) to avoid being charged
5. User Responsibilities and Prohibited Uses
5.1 Acceptable Use
You agree to use the App only for lawful, educational, and entertainment purposes and in accordance with these Terms. You are responsible for:
- Maintaining the security of your device and account
- Ensuring you have the right to submit any images or content for analysis
- Using the service in compliance with all applicable laws and regulations
- Understanding that all identifications are approximate suggestions for educational/entertainment purposes only
- NOT relying on the app for medical, safety, pest control, or professional identification decisions
- Consulting professional entomologists, pest control experts, or medical professionals for any important decisions
- Verifying all identifications with qualified professionals when accuracy matters
- Understanding that AI-based identifications can be significantly inaccurate or completely wrong
- Not using the app to determine if an insect is dangerous, venomous, or harmful
- Seeking immediate medical attention for insect bites or stings rather than relying on app information
5.2 Prohibited Activities
You may not:
- Use the App for any illegal or unauthorized purpose
- Reverse engineer, decompile, or disassemble the App
- Share your subscription access with others
- Submit content that violates intellectual property rights
- Attempt to circumvent usage limitations or technical measures
- Use the App in a way that could damage or impair our services
- Submit inappropriate, offensive, or harmful content
- Use the App for commercial purposes without our written permission
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use identification results to make medical, safety, or pest control decisions without professional consultation
6. Privacy and Data Collection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
7. Intellectual Property
The App and all its content, features, and functionality are owned by Viksva, MB and are protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App solely for your personal, non-commercial use.
8. Third-Party Services and AI Limitations
The App integrates with third-party services including but not limited to:
- AI services for image analysis and insect identification processing
- RevenueCat for subscription management
- Apple App Store and Google Play Store for payment processing
- Analytics services for app improvement
These third parties have their own terms of service and privacy policies. We are not responsible for the practices or content of these third-party services.
AI LIMITATIONS AND ERRORS: The AI technology used in this app can and WILL make mistakes. AI-generated identifications may contain significant errors, inaccuracies, or be completely incorrect. AI identification is NOT accurate and should NOT be treated as a professional, scientific, or authoritative identification. This is an EDUCATIONAL AND ENTERTAINMENT TOOL ONLY, not a professional identification service. ALL IDENTIFICATIONS ARE APPROXIMATE SUGGESTIONS ONLY. Accuracy depends on many unpredictable factors including image quality, lighting, insect positioning, species variation, and AI interpretation errors. You MUST consult professional entomologists, pest control experts, or medical professionals for any decisions that matter. We have ABSOLUTELY NO LIABILITY for any errors, inaccuracies, or incorrect identifications produced by AI services. DO NOT use this app to determine if an insect is dangerous, venomous, or harmful. DO NOT use this app for medical decisions regarding bites or stings. DO NOT use this app for professional pest control decisions.
9. Service Availability and Modifications
- We strive to provide continuous service but cannot guarantee uninterrupted availability
- We reserve the right to modify, suspend, or discontinue the App or any features at any time
- We may update the App to improve functionality, security, or compliance
- Critical updates may be required for continued service access
10. Disclaimers and Limitation of Liability
10.1 Service Disclaimers

- We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose

- OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM

- WE ARE NOT LIABLE FOR ANY MEDICAL CONSEQUENCES FROM INSECT BITES, STINGS, OR ALLERGIC REACTIONS WHERE THE APP WAS CONSULTED
- WE ARE NOT LIABLE FOR ANY PEST CONTROL FAILURES OR INFESTATIONS RESULTING FROM RELIANCE ON APP IDENTIFICATIONS
- WE ARE NOT LIABLE FOR ANY PROPERTY DAMAGE FROM INCORRECT PEST IDENTIFICATION
- WE ARE NOT RESPONSIBLE FOR ANY HARM ARISING FROM FAILURE TO IDENTIFY DANGEROUS, VENOMOUS, OR HARMFUL INSECTS
- WE ARE NOT LIABLE FOR ANY REGULATORY VIOLATIONS OR LEGAL ISSUES ARISING FROM USE OF THIS APP
11. Indemnification
INDEMNIFICATION: You agree to indemnify and hold harmless Viksva, MB, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Any content or images you submit through the App
- Any consequences resulting from reliance on identifications provided by the App
- Any decisions made based on the App's identifications
- Any errors, inaccuracies, or incorrect identifications provided by AI services
- Any medical, safety, or pest control issues arising from use of identifications
- Any harm, injury, illness, or death resulting from misidentification of insects
- Any medical consequences from insect bites, stings, or allergic reactions
- Any property damage or pest infestations
- Any violations of laws or regulations arising from use of this App
12. Termination
We may terminate or suspend your access to the App immediately, without prior notice, for any reason including violation of these Terms. Upon termination:
- Your right to use the App ceases immediately
- You remain liable for all charges incurred prior to termination
- Subscription billing continues until cancelled through your app store account
- Provisions regarding liability, indemnification, and governing law survive termination
13. Governing Law and Dispute Resolution
- These Terms are governed by the laws of Lithuania
- Any disputes shall be resolved exclusively in the courts of Lithuania
- You consent to the jurisdiction of Lithuanian courts
- If any provision of these Terms is found unenforceable, the remaining provisions remain in effect
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by:
- Posting updated Terms in the App
- Updating the "Last Updated" date
- Providing in-app notification for significant changes
Continued use of the App after changes constitutes acceptance of the updated Terms.
15. App Store Specific Terms
15.1 Apple App Store Additional Terms
For users who download the App from the Apple App Store, the following additional terms apply:
- These Terms are between you and Viksva, MB only, not with Apple Inc.
- Apple is not responsible for the App or its content
- Apple has no obligation to provide support services for the App
- All payments and refunds are handled exclusively by Apple in accordance with Apple's policies
- Apple is a third-party beneficiary of these Terms and may enforce them against you
- Apple is not responsible for any consequences resulting from identifications or your use of the App
15.2 Google Play Store Additional Terms
For users who download the App from Google Play Store, the following additional terms apply:
- These Terms are between you and Viksva, MB only, not with Google LLC
- Google is not responsible for the App or its content
- Google has no obligation to provide support services for the App
- All payments and refunds are handled exclusively by Google in accordance with Google Play's policies
- Google is not responsible for any consequences resulting from identifications or your use of the App
16. Contact Information
17. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Viksva, MB regarding the use of the App and supersede all prior agreements and understandings.
FINAL WARNING: By using this app, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
